Smokers Choice is a registered not for profit group, who's sole mandate is to provide a social setting for those who choose to associate in an atmosphere that may contain second hand smoke.
For the past seven years our founder, Mike Kennedy, has been abused by the City of Ottawa and the Province of Ontario by them forcing our group and it affiliates to PROVE THEIR INNOCENCE.
Mr. Kennedy has documented evidence that does prove that the only places that Health Units or By-Law Offices can enter are those places that are open to the general public. Private Clubs are private members only facilities.
Smokers Choice has been granted, on June 17, 2008, Leave for Appeal to the highest court in Ontario.
The basic argument that the Health Unit has brought forward is that the only place that is private in Ontario is your home. All other places whether or not privately used are now public.
This determination comes from the fact that private places are not mentioned in the provincial law.
When did British Common Law require specific exemptions for what is legal?
Using this logic because there is no exemption in law for abortion which would criminalize women and their physicians for performing a "non-exempted procedure".
Following their same logic the home which is not exempted in the public places section of the Smoke Free Ontario Act means they can kick your door in any time they please.
We have already been found not to be a workplace in our operation and service. The only thing we require is to be found to be private, if the Hell's Angels club house requires a search warrant so does ours. We are no more or no less a private organization than any other.
